On 12.8.14 the Administrative Services Committee held a meeting. Roll call showed Paul, Chris and Nancy present and Eric absent. Three of the four members present provided a quorum.

But wait, there were eighteen guests also present. All eighteen of these guests were paid employees of the County. Seventeen of them under the direct supervision of the big guy himself who was also present. Purpose: overwhelm the three volunteer committee members just how great life would be in King Louie (even though the paid staff was unable to answer many questions with certainty).  Minutes of 12.8.14 Meeting available here Board Report 12-15-2014

One week later 12.15.14 Parks & Rec Committee of the Whole discussed. (Minutes not available).

Moments later 12.15.14 Parks & Rec Commissioners approved. (Minutes not available).

Johnson County Board of County Commissioners have now disclosed that the King Louie Property is currently worth $850,000 assuming the demolition of the King Louie Building at an estimated expense of $400,000.

So let me get this straight.  We are still paying interest on the $3,600,000 that we have already spent and if we spend another $400,000 (making $4,000,000 total) we’ll have something valued at 21.25% of our investment?  Sound impossible, even for government? Here is what we discovered.

  • Because the initial purchase was made with cash tax dollars, no one thought or were required to have an appraisal of the property. (Confirmed by KORA request)
  •  The leasing bank failed their fiduciary responsibilities to acquire an appraisal to ensure the funds were secured by a like valued asset. (Confirmed by KORA request)

After nearly 3 years of public resistance/resentment following this purchase and repairs, JoCo BOCC is attempting again to legitimize this failure of due diligence. On December 18, 2014 the existence of an appraisal was made known in an attempt to justify even more money.

NOlathe executed a lawful KORA request and received this 100 page document dated April 9, 2014  201408FormerKingLouieAppraisalReportwithPIV  just a few highlights:

Page 38- “The improvements are in a shell condition, and it is not likely that the property can continue to support the existing improvements well into the future. The building itself has exhausted its useful life and has many characteristics that pose serious challenges for conversion.”

Page 47- “Our value of the subject property with the current improvements in place is $550,000. The value of the subject property as a cleared vacant site ready for redevelopment based on the land value estimated in the following section of this report, less the demolition costs of the existing building is $850,000. Based on these estimations, it appears the current improvements do not contribute additional value to the site. We have concluded the highest and best use of the subject property to be razing the existing improvements for redevelopment to a residential use.”

So this 1959 steel and concrete building albeit iconic is wore out.

After $3,600,000 already expensed the property is only worth $550,000? But if we spend another $400,000 it might be worth $850,000?

One year ago we sued JoCo BOCC for violating The Home Rule Charter for the methods they used in replacing the County Mental Health Commission. Even though we had shown the JoCo BOCC two lawful methods to accomplish the same result, many felt we were anti Mental Health. So here we go again, many will believe we are anti Parks and Recreation.

My oath is not up for renewal every four years. Mine lasts a lifetime. Our next post will reveal more KORA information regarding this near panic to bring Parks and Rec in to King Louie January 2015.

Commissioner Allen’s landmark legislation is literally a landmark.  Although most of us call it the county dump.

In opposition to retro-active Kansas Law but within compliance to significant campaign contributions, Johnson County remains aligned with Deffenbaugh Industries (aka Waste Management) when it comes to your trash.  On December 11, 2014 Board of County Commissioners voted 4-3 to continue this mandatory contractual requirement which yields no measurable or beneficial use of landfill utilization or commodity re-use:

  • Deffenbaugh pays to the County $350,000 a year.
  • Deffenbaugh is billed for two County Employee wages/benefits.
  • Deffenbaugh directly/indirectly controls County waste management vision.
  • Deffenbaugh allowed to double customer fees to recoup expenses resulting from above.

November 2011– During two consecutive Johnson County Board of Commissioners Meetings, the Board approved on a 6-1 vote to purchase the King Louie building for $2,000,000 and make it weather tight with an additional $1,600,000.  Although denied later, the intent was to house a “National Museum of Suburbia” after additional commitments totalling $40,000,000 could be identified.  The immediacy of completing the transaction before year-end was for tax purposes of the then current owner.

December 2011– The then current owner used the Purchase Agreement as a bankable note to barrow enough money to retire an existing lien against the property. With a clear Title, the transaction was finalized.

January 2012– Board notified that having used cash reserves for the purchase and plans for using cash reserves for restoration would jeopardize Bond Rating. County leases property to a bank for $3,600,000 and then leases the property back from that bank with repayments scheduled through 2015.

Public unrest through-out 2012 culminates in November election of Steve Klika to Board of Commissioners vowing not to support further funding of the property.

During 2013 and 2014 displayed Commissioners Eilert, Peterson and Allen (former mayors) in support of additional funding with Ashcraft, Klika, Osterhaus and Toplikar remaining opposed. Rumors abound that Chairman Eilert would resurrect his iconic dream in 2015 when he had the votes.

But Ashcraft and Osterhaus were re-elected in November 2014.  The vote remained 3-4.  That left Toplikar and/or Klika to change their position in order to fund King Louie.

Then this repackaged funding for King Louie kinglouie12.18.14 appears for discussion. BINGO! The vote was actually taken last week! Commissioner Klika’s passion is mass transit.  Chairman Eilert fast tracked approval of Klika’s passion last week and tomorrow is pay back time.

December 18, 2014 Committee of the Whole vote to fully fund King Louie 4-3.

Incredibly we also learned that our $3,600,000 investment is currently only valued at $850,000 so we should trust that they now know what they’re doing?

Previous NOlathe posts have shown the costs of illegal immigration in regards to education funding for the State of Kansas.  This post will begin looking at the local municiple benefits of illegal immigration which is openly accepted and maybe even encouraged.  We started by identifying the population of Garden City for the years 2001 through 2009.  To account for regional commerce we also identified the population for Finney County for the same years.  Our source is the US Census Bureau http://factfinder.census.gov/servlet/GCTTable?_bm=y&-context=gct&-ds_name=PEP_2009_EST&-_box_head_nbr=GCT-T1&-CONTEXT=gct&-mt_name=PEP_2008_EST_GCTT1_US43&-tree_id=806&-redoLog=false&-geo_id=04000US20&-_sse=on&-format=ST-9&-_lang=en and should be ‘book marked’ for those doing research requiring Kansas population information.  Combining this new information with previously posted information on the Garden City School District we have this data table.
