Mr. Attorney General,
Please accept this as a signed complaint regarding Johnson County Board of County Commissioners refusal to supply documents as a result of a legal KORA request dated March 18, 2012 viewed here Clarion KORA Request and the response dated March 20, 2012 viewed here Clarion KORA Response .
I respectfully request that this complaint remain in control of your office and not forwarded to the Office of Johnson County District Attorney Steve Howe. Sitting County Commissioners violated the County’s Home Rule Charter by endorsing Mr. Howe during the 2008 campaign Section 2.07. PROHIBITIONS. No Commission member shall directly interfere with the conduct of any agency or any department, or any part thereof, including the appointment or removal of employees, except at the express direction of the Commission or as otherwise provided by this Charter.
As the District Attorney, I have met with him personally or with immediate Staff on two occasions submitting two complaints on the conduct of one or more of the Commissioners. With multiple follow-ups on my part, now more than two years later there has been no decision rendered by the DA Office and consistent with this recent report on “Transparency” http://www.stateintegrity.org/
The County Cites KSA 45-217g “”Public record” means any recorded information, regardless of form or characteristics, which is made, maintained or kept by or is in the possession of any public agency including, but not limited to, an agreement in settlement of litigation involving the Kansas public employees retirement system and the investment of moneys of the fund. http://www.kslegislature.org/li/b2011_12/statute/045_000_0000_chapter/045_002_0000_article/045_002_0017_section/045_002_0017_k/
Before dissecting the County’s response, allow me to provide some history:
- Citizens’ Visioning Committee formed by The County Commission on September 17, 2009 to develop 20 year plan towards “sustainability” submits request to hire Clarion Associates as a “professional facilitator” at a sum not to exceed $194,685. Clarion Justification 9.17.2009

Johnson County Board of County Commissioners selectfully formed a committee to create a 20 year plan and then hired a facilitator at $194,685 to direct the committee to a pre-determined conclusion (that’s what facilitators do). That brings us to the basis of this submitted Complaint.

Non-Partisan County Commission Pays Democratic Party To Draft County Budget.

JOCO BUDGET – CITIZEN DISCUSSION GROUPS
Consensus Consulting will hold citizen focus group discussions on the upcoming Johnson County budget. Focus groups will be organized by JOCO Commission district. Each district will have a date for the focus group to meet and answer questions on what’s important for the county budget.
The dates for focus groups are: Dist. 1- Wednesday, February 15; Dist. 2- Thursday, February 9; Dist. 3- Thursday, March 1; Dist. 4- Monday, February 13; Dist. 5- Monday, March 12; Dist. 6- Wednesday, February 8. Meetings will be from 6 – 8 pm at a central location in each district to be announced. Focus groups gives Johnson County residents a voice on budget priorities
If you are a Johnson County resident, the Johnson County Board of County Commissioners would like to invite you to dinner and a focus group of residents in your district. As a result of a challenging economy, commissioners are facing some hard choices related to balancing the budget and they want to know what residents think. They have hired Consensus to conduct focus groups to find out.
At the focus group, you would complete an online budget simulator and then work with other residents to discuss the results. Only a dozen people from each district can be included in each focus group, and we are seeking a mix of people who roughly reflect each district. To be eligible to participate, neither you nor a member of your immediate family can be employed by Johnson County government and you must be at least 18 years of age.
You do not need to be an expert in the Johnson County budget. We won’t be asking you technical questions. Instead, we’ll be interested in how you made your decisions and what mattered most to you when you considered different choices. We’re looking forward to a lively, honest discussion.

After spending some hours searching through Johnson County documents to determine the history of this action, I finally submitted a KORA (Kansas Open Records Act) request at 12:01 am Wednesday January 25 and received the requested information at 5:13 pm January 27. Here is what we found.
During an unrecorded and undocumented discussion occuring at a “Retreat” (exempt from Kansas Open Meeting Act) on November 10, 2011 Agenda11-10-2011 Commissioner Peterson (from the SPAR Committee) submitted two documents 2011GeneralGovernmentSPARAgenda & CitizenEngagementProposedProcess10-20-11. Following an undocumented 30 minute discussion, the County Manager was directed to solicit a Consensus KC agreement for the purpose to receive focus group input in drafting the 2013 County Budget.
Without a vote and in the absence of an official County meeting, the County Manager signed an agreement on December 16, 2011 with Consensus KC for $11,495 ConsensusKCAgreement2011.
Look at this agreement. The questions asked and the interpretation of the responses, is at the sole discretion of Consensus KC. Twelve focus groups will be evaluated, six (one for each District) above the voting age of 18 and six more conducted in schools for those under the voting age of 18.

For almost 20 years after its founding in 1984, Consensus functioned very much like a traditional nonprofit. Then, in 2003, Consensus chose a new path. We were influenced by new trends in nonprofit leadership that focused on entrepre¬neurialism and earned income, and by increased competition for a shrinking pool of operating funds.
Consensus took two actions that set it apart from most other nonprofits. It developed a business plan for earned income and it became a “virtual” organization, with an active working board, no office space and staff members who work on contract. Both decisions have increased the organization’s flexibility, cost-effectiveness and profile while maintaining its focus on the mission of putting the public in public policy.

Conclusions:

Although the “Home Rule Charter Commission” recently confirmed that Johnson County politics shall remain “non-partisan”, our Commissioners have paid the County Democratic Party to draft the 2013 Budget.

On January 27 and with the delivery of KORA documents above, additional sources such as area Chambers advertised these ‘focus groups’ (four days after JoCoDems). Nice try boys.

In November 2011 our Commissioners paid another ‘focus group’ organization (Clarion) to develop a “vision” for The County costing $194,658.

Earlier this week The Kansas Chamber of Commerce targeted three State Senators from Johnson County for defeat in 2012. By name Senators Vratil, Owens and Huntington for not supporting the Kansas business community. A fairly bold step to fund Republican campaigns to defeat other republicans.
If you live in Johnson County, you know that Overland Park is the political power house and often attempts to control Topeka. I should have said “has been”. Thangs aira changin round heer.
Recently managed by Mary Birch, controlled by Dick Bond and Ed Eilert, let’s look at how these Overland Park Chamber folks measure the performance of the County’s State Senators. The chart below measures Senator votes aligned with the 2011 Overland Park Chamber’s position. The higher the percentage the more aligned with the Overland Park Chamber. I’ll be dog-gone! County Commissioners Pay For And Award National Museum To Overland Park

Responding to multiple requests we will start with clear identification of Johnson County’s Seven Dwarfs. (Place curser over pix for ID’s, we think we nailed them perfectly.) Future posts regarding The Dwarfs will maintain this header for reference.
The Johnson County Museum has been looking for a new location since late 2009. On November 10 and 17, 2011 presentations were made to The Seven Dwarfs regarding the purchase of a vacant building in Overland Park. This is a summary of those two meetings.
He just said they are proposing to buy a building and make it safe until such time as The Dwarfs decide what to do with it? So how much is this going to cost and how are we going to pay for it?
And we need a new museum building because why?
The current museum location is in Shawnee. What does Sleepy have to say?
Sneezy provides legal counsel to Overland Park “achoos” on the subject.
The old museum building has 23,000 square feet (and it’s paid for), the new museum building has 70,000 square feet. Can someone please tell me?
Why?
The Dwarfs have decided to move the Johnson County Museum to Overland Park. So what?
And how will this save money?
Any intelligent questions before the vote?
We obtained all the information available from the Secretary of State regarding Western Development Co. Inc and found no obvious connections to The Dwarfs. That information will be shared upon request. Our conclusions are :
- This property does not have parking capacity to support the purpose.
- This property is “an eye sore” for the Metcalf Corridor.
- There may be yet identified benefactors from the sale of this property.
- Five of the five County Commissioners representing Overland Park voted in support.
- $3,600,000 has been committed without regard to how it will be financed.
- Johnson County AAA Bond rating is now at risk.
- Nearly $40,000,000 has been committed without regard to how or when or how financed.
- Some contractors in Overland Park have benefited from campaign contributions.
- Some developers in Overland Park have benefited from campaign contributions.
- Museums are more important than Court Houses or Libraries.

Clearly the recorded response does not address the recorded question. So either the County Commissioners are accountable for providing the wrong documentation of the discussion or changed the minutes after approved by the Charter Commissioners for posting.
Kudos to Charter Commissioners Copeland and Pirner for trying. But just like Jurassic Park the predatorial dinosaurs of Overland Park are thriving. Here’s a typical response to my requests for redistricting in February 2011.
The 2001 redistricting was done following the publics’ approval. So the dominant Overland Park representation made sure that the pre and post redistricting favored Overland Park. Currently 5 of the 7 County Commissioners have Overland Park roots, votes and funding while Overland Park represents less than 30% of the entire County population and declining. If the Charter Commission moves forward with expanding the County Commissioners to 9 members, these Districts should at least be identified and publicized prior to the publics’ vote of approval. Our research makes it clear that if these Districts are formed post Charter Ammendment public approval, the ratio will be 6 or 7 of the 9.
With all things considered, a reasonable person could easily conclude that attending the next Public Hearing scheduled for September 27 would be a waste of time. The County Commissioners have collectively and united as one succeeded in derailing any attempt of improving “The most effective government is the one closest to the people.”

Repealing Home Rule Charter Remains An Option

Quite deliberately, the Johnson County Board of Commissioners and Staff have redirected the Home Rule Charter Commission into an area of unknown territory. The citizenry will have to live with the results for another ten years as a result. The Home Rule Charter Commissioners are participating in this activity without pay and with a great sacrifice of their personal time. It’s truly a shame that after many months of meetings and with only a few months left before they are required to make recommendations, the following is their highest priority for the next Public Hearing for comments.
“Consider supporting an amendment to the state statute to provide for protection of “whistleblowers” in connection with audits. KSA 45-221i governs the information that must be made available to the public and may be the appropriate statute use to correct this problem. An amendment to paragraph (5) something like the following might do the job: “Information which would reveal the identity of any undercover agent, any informant reporting a specific violation of law or any individual who provides information to a county, municipal or state auditor in connection with or related to the duties of such auditor.” This part of the statute already provides for the protection of the identity of undercover agents and informants reporting violations of law.”
A reasonable person could conclude this experiment led by politicians of SELF RULE is an abominable failure. It starts with how the Charter Commissioners are selected. Most if not nearly all are determined by other folks with a R or D after their name. There are significant political agendas at play here and in general they appear to be satisfied with a disfunctional County government.
Also abundantly clear here is the absolute power of a few Overland Park current and former politicians. All friends with a failed publicist and behind the scenes power broker. Not to name names but let’s start with Dick Bond, John Vratil, Ed Eilert, Mary Birch, Steve Rose, Larry Winn II & III. There is an assortment of others but less significant in their influence including the current Overland Park Mayor.
The ‘key stone’ in this fiasco lies directly with District Attorney Steve Howe who has the only authority to investigate wrong doing in a Home Rule Charter Johnson County. He continues to refuse. Wonder why?
All while the remaining six County Commissioners play “see no evil, hear no evil and say no evil” cuz that’s what they were told to do. Maybe the real folks in Johnson County should vote to repeal The Home Rule Charter.

Such report shall include recommendations of the 2011 Charter Commission and such other information deemed important. Recommendations of the 2011 Charter Commission may include suggested changes in the administration of the County government, programs, and activities. It may also include proposed amendments to the Charter. All recommendations of the 2011 Charter Commission shall be adopted by a majority vote of its membership. The 2011 Charter Commission, as established by the resolution, shall terminate on the date that follows by 30 days the submission of its report.”

There was no meeting scheduled between August 15 and September 27. Yet in the absence of approved minutes for August 15 and the absence of an agenda for September 27, another Public Hearing was scheduled.
During the time since our discovery, another meeting was held on September 12 and a more formal notification has been provided. We found the Charter Commissioners were asked at the September 12 meeting to complete this questionaire (the hand written numbers to the left are so we can keep track of later tabulations).
Twenty questions were asked. Why did the Board of County Commissioners’ Clerk only release tabulations for 17 of the 20 questions and who made that decision? What were the 3 subjects omitted from the Public Hearing Agenda and why? What questions asked are outside the Constitutional authority of the Home Rule Charter Commission? #2 BOCC Meetings: A charter provision to review of county commission minimum meeting (frequency) requirements and their practicality.
#3 Audit Financial Impacts: A charter provision to audit stated financial impact of audit reports following departmental implementation and presenting formal results annually to County Commissioners.
#19 Removal of Independent Board Members by the Board of County Commissioners: Support an amendment to the home rule statute to allow the Board of County Commissioners to remove any appointed member of boards, commissioners and other public bodies, appointed by the Board of County Commissioners, subject to the provision of an administrative hearing if requested.
NOlathe note: During several of the discussions this year, the Charter Commission ran in to obstacles involving existing State Statutes. However honorable the desires to change Kansas laws may be, this lies outside the scope of the 2011 Charter Commission. This Commission will not be active again for ten years and their energies must be directed towards improving the Home Rule Charter with the laws that are in affect today.

“Whistleblowers” and Open Records Requests: Consider supporting an amendment to the state statute to provide for protection of “whistleblowers” in connection with audits. KSA 45-221i governs the information that must be made available to the public and may be the appropriate statute use to correct this problem. An amendment to paragraph (5) something like the following might do the job: “Information which would reveal the identity of any undercover agent, any informant reporting a specific violation of law or any individual who provides information to a county, municipal or state auditor in connection with or related to the duties of such auditor.” This part of the statute already provides for the protection of the identity of undercover agents and informants reporting violations of law.
